Normative Resolution 88 - Visa concessions for training - Definition

Normative Resolution 88


The National Immigration Council (CNIg) approved the Normative Resolution No. 88 of September 15th, 2010 that organizes the visas concessions to the foreign who come to Brazil for training.

For this new resolution is considered training “the supervised school education developed in the workplace, that aims the preparation of students who are attending regular education in higher education institutions”.

The visa must be requested abroad to the diplomatic missions, consular offices and vice-consulates.

The validity of this law is up to 1 (one) year, extendable once for the same period, which circumstance will be shown at Foreign Identity Card, and also the trainee status.

The RN 88 allows trainees to receive allowance to maintain themselves, as well as the other benefits under Brazilian training law.

For this new resolution, were repealed the resolutions which used to organize the training visa concessions, Normative Resolution No. 41/1999 and No. 42/1999.

Normative Resolution 87 - Visa Concessions to receive professional training

The National Immigration Council (CNIg) approved the Normative Resolution No. 87 of September 15th, 2010 that organizes the visas concessions to the foreign connected to the foreign company, to receive professional training with the branch, subsidiary or Brazilian Matrix belonging to the same economic group.

Article 1, paragraph, of this resolution defines the concept of professional training as “the activity that aims to develop skills and knowledge through practical work.”

The visa statute of this new resolution will follow the Normative depending on prior authorization of the Ministry of Labor and Employment (MTE).

The validity of the visa will be up to 1 (one) year, non-extendable, this circumstance will be shown at the Foreign Identity Card.

The article 3 stipulates that the Ministry of Labor and Employment (MTE) may reject an application for a visa if there is a circumstantial evidence of the company’s interest to make mere substitution of national to foreign labor.

Finally, we see this new law repealed the Normative Resolution 37/1999, concerning the visa concessions to foreign who wanted to come to the country for professional training, after their university graduation, without any employment link in Brazil.

Normative Resolution #84 - FGTS over foreign portion of salary for expats

The Ministry of Labor and Employment has published the Normative Resolution No. 84, of July 13th 2010, which foresees regarding the inspection on the payment of the Guarantee Fund for Length of Service (FGTS).

The Article 8, sole paragraph, clause V, of this Normative Resolution foresees that the collection of FGTS and CS (Social Contribution) under the paid or payable remuneration to employees, in percentages established by the law be collected based on the remuneration paid to the foreign employee, working in Brazil, regardless where the payment of the salary is done.

Therefore, it is converted into a rule the understanding that the portion received by the foreign employee abroad is also subject to collection of FGTS.

Labor inspectors are doing due diligence at the companies to ensure they are following this Normative Resolution.

This Normative Resolution issued by Presidency, regulates the enforceability of the contribution, however, we recommend our clients to consult their tax lawyer about the legality and applicability of this Normative Resolution.

Brazilian Identity Card (ID)

From October 2010 the Brazilian Government will start to issue a new model of ID in Brazil, which will have ten digits (a sequence of nine numbers plus a check digit).


Currently, each state adopts a different numbering systems and its own emission, which leads to fraud and enables one person to make more documents. The intention is to exchange all documents - are 150 million today - up to ten years.

The model is similar to a bank card with chip - which include personal data, Individual taxpayers number and voter registration. Furthermore, the document will also have a fingerprint adapted to AFIS (Automated Fingerprint Identification System). Thus, in any establishment in the country, you can compare the digital and see if the document is indeed in the hand of its owner.

Visa to the USA

The Brazilian Ministry of Foreign Affairs and the US Embassy in Brazil announced the reciprocal concession of 10-years validity visas for the purposes of tourism and business since May 28th 2010.

Both of the countries also decided to eliminate the extras fees charged for visas issued for business travel, students and exchange visitors/visiting professors.  For these types of visas, although, it will still be applied a fee to pick up the passport.

Personal Address

We inform that it will not be allowed anymore registrations at the Federal Police to issue RNE with the company address in the field ‘residential address. For the foreign citizens who still have no residential address it can be used the hotel address where they are staying, and after the definition of the place of residence in Brazil, the foreign citizen should request a change of address at the Federal Police. 

Normative Resolution #86

The National Immigration Council (CNIg) approved the Normative Resolution #86 of May 12th 2010, which instructs the concession of visas item I to athletes for intensive training in sports.

The visa regulated by this new Resolution only applies to foreign citizens who are between 14 to 21 years old and is approved by the Ministry of Foreign Affairs. The request of this type of visa should be applied at a Brazilian consulate or embassy abroad.

The validity of this visa will be up to 12 months, being allowed its extension successively upon confirmation of registration at school, good grades, among other requirements.

The Resolution #86/2010 forbids the remuneration of the foreign citizen’s contemplated by this visa, except for the payment of financial aid.

It should be noticed that this new resolution revoked the Resolution #26/1998, which instructs the visa permit intended for intensive training to athletes who are under 21 years old.

RESOLUTION #85/2010 OF THE NACIONAL IMMIGRATION COUNCIL

The Resolution #85 of the National Immigration Council (CNIg) of April 30th 2010 changes the Resolution 36/1999, which deals with the procedures to apply for family reunion.

The new Law contemplates the dependents of the foreign citizens beneficiary by the Law 11.961/2009, the Amnesty Law, who have obtained temporary residency in Brazil. It  determines that:

1 – For the dependents of the foreign citizens who are in Brazil, assisted by the Law 11.961/2009, it can be issued a permanent visa, and this registration should be linked to the validity date of the temporary registration of the main holder;

2 – If the foreign citizen is in Brazil in regular conditions, the Ministry of Justice can issue temporary residency;

3 – The dependent condition of foreign citizen beneficiary by the Law 11.961/2009 should be in his National Registry of Foreigners (CIE).

Rectifications made to the Immigration Division (DIM) of the Ministry of Foreign Affairs (MRE)

The chief of the DIM – MRE has sent an official communicate to the Brazilian representations abroad, instructing the consular section not to receive uncompleted forms.

The correction service, provided by DIM, serves to complement or correct the forms and visas, which have errors in the fields filled up by Brazilian representations abroad.
 
DIM does not make rectifications in the fields filled by the foreign citizens, and there are pending on the information that should have been provided by such foreign citizens, the rectification must be made by the consulate where the visa was issued.
 
All information requested on the forms must be filled, and the DIM will not rectify incomplete or incorrectly completed forms by the foreign citizen.

Exception of Mexican Visa for holders of American Visa

The follow information is found at the Mexican consulate website in São Paulo:

“In order to offer even more facilities migrating to visit Mexico, since May 1st 2010, all foreign citizens in the categories of tourism, business and traffic who hold a visa valid in the United States may enter in Mexico without a Mexican visa presenting the U.S. visa and passport valid for at least six months. Therefore, it is not necessary to submit to the Consulate to apply for any extra authorization. In other migratory categories, Brazilian citizens will request a visa, as usual."

On verification of the subject in Mexico, we note that this information has not been published yet in the Mexican Official Gazette; it was just published in a circular of the Instituto Nacional de Migración. Therefore, it may change without notice.

It is important to notice in this first stage, that the employees from the Mexican Airlines or even from the Mexican Immigration do not know the subject yet. For this reason, it is advisable to get a printed version of the information, from the website.

Resolution #345 - Brazilian Drivers License - CNH

Brazilian driver´s license (CNH)

The Resolution # 345 of the National Traffic Counsel (CONTRAN) of March 19th 2010 has changed the Resolution 193/2006, which deals with the regulation of the Applicant or foreign citizen Driver in Brazil.
It follows information about the Brazilian driver´s license (CNH) to the foreign citizens who hold the following requests:
1 – Transforming a Temporary visa into a Permanent Visa;
2 – Extensions of Temporary visa to Permanent visa in the Ministry of Justice (MJ); and
3 – Requests of permanent residency in Brazil basis on marriage with a Brazilian spouse or Brazilian son or daughter.
   The foreign citizens in the above situation may not issue or renew the CNH - they should drive with the International Driver´s License (CIH), valid and with the stamp of the State Traffic Department (DETRAN). If the foreign citizens do not hold a CIH, they cannot drive until the visa is approved and issued the protocol of National registry of foreigners (RNE).

Employees from the Regional Department Of Labor And Employment go on strike


The employees from the Regional Department of Labor and Employment (SRTE) in São Paulo, Brazil, decided to go on indefinite strike since April 12th 2010.

From that date, EMDOC cannot provide services of issuance or extension Work Book (CTPS, abbreviation in Portuguese).

EMDOC will keep their clients updated about this strike and about returning the activities to normal.

NI 111 - National Department of Trade Regulation

Normative Instruction No. 111/2010
It was published at the Official Gazette the Normative Instruction No. 111 of the National Department of Trade Regulation, regulator of the Board of Trade of Brazil, which deals about the residence of foreign citizens from the countries part of MERCOSUL, Bolivia and Chile.
According to this Normative Instruction, the foreign citizen who obtained temporary residence authorization based on the New Agreement of MERCOSUL, Bolivia and Chile (Decree No. 6.975 of October 7th 2009) can be appointed as administrator, and the Board of Trade can file the corporate acts normally.

The Ministry of Justice exempts the submission of Non-Criminal Record Certificate to the process of permanence based on marriage with Brazilian spouse.
The Federal Police of São Paulo and São José dos Campos are already working this way.
As it is a new procedure, we should research before filing the process in another unit of the Federal Police.
The website of the Ministry of Justice is updated and the Non-Criminal Record Certificate does not appear as a necessary document to this process.

Changes in registration - Policia Federal Sao Paulo

Changes in registration in the Federal Police of São Paulo
The Federal Police of São Paulo has changed its procedures to register a foreign citizen.
It is not necessary anymore to request a password to schedule a registration in the Federal Police of São Paulo. The registration will occur in the same day that was scheduled.
The Federal Police has also restricted the amount of registration completed each day by each contractor. It will be allowed to schedule 3 (three) clients by day. If one of these clients is a ‘family’, the contractor cannot schedule another registration in the same day.
The foreign citizen who still holds a password to the service will be registered on the scheduled date. There will not be anticipation of the registration to those holding a password. Anticipation will only be possible upon presenting flight ticket.

International Schools in Belo Horizonte

Hello There,

Today we will talk about International Schools in Belo Horizonte. We do not have many options, as only two schools could be called international, as their curriculums are accepted elsewhere then Brazil plus an elementary Canadian school.

American School of Belo Horizonte (http://www.eabh.com.br) - Teaches in English and have native English speakers in their faculty. It's the only school in Belo Horizonte that have IB (International Baccalaureate - http://www.ibo.org) Accreditation. It also have the United States SACS accreditation that generates high school graduation both in Brazil and U.S.A. Scholarship programs for Sports also are a good attraction.

Fundacao Torino (http://fundacaotorino.com.br) - Teaches in Italian and have native italian speakers in their faculty. It belongs to the FIAT foundation and was originally founded to support the FIAT expats that moved to Belo Horizonte, when the factory was established in Betim. Today their curriculum generates accreditation in both Brazil and Europe.

You can also find just elementary type school, as Maple Bear (http://www.maplebear.com.br) that have Brazil and Canada accreditation. They have two units in Belo Horizonte today. It's a franchise style school that have grown quite well during the past two years.

Well people, simple information that can open some doors. Next post will be related to Belo Horizonte Cultural aspects and it's residents.
